Part A — General
01 About these terms
These Terms and Conditions govern your use of alloystorage.com and any purchase or rental you make from Alloy Storage, of 151 Alloy Drive, Saint John, New Brunswick E2M 7S9 ("Alloy Storage", "we", "us", "our").
By using this website, submitting an enquiry, placing an order, or taking delivery of a container, you agree to these terms. If you do not agree, please do not use the site or order from us.
A separate signed Rental Agreement applies to every container rental and sets out the specific terms of that rental. Where the Rental Agreement and these terms differ, the Rental Agreement governs.
02 Definitions
- Container — any Alloy-Series flat-pack container, storage container, or related unit supplied by us.
- Goods — any container or accessory sold to you.
- Rental — a container supplied to you on a periodic rental basis, remaining our property throughout.
- Site — the address where a container is delivered, placed, assembled, or stored.
- Order — your request to buy or rent, whether placed online, by phone, or by email.
03 Using this website
You must be at least the age of majority in your province and legally able to enter a binding contract. If ordering on behalf of a business, you confirm you are authorised to bind that business.
You agree not to:
- Use the site for any unlawful purpose or in breach of these terms.
- Attempt to gain unauthorised access to the site or any connected system.
- Introduce malicious code, or scrape, harvest, or republish site content without permission.
- Submit false, misleading, or fraudulent information.
We may suspend or refuse access to anyone who breaches these terms.
04 Products and descriptions
We take care to describe our containers accurately. Photographs, renders, and dimensions are provided as a guide. Colours may vary between screens, and stated sizes are nominal — minor variations in finish, fittings, and measurement can occur between production batches.
All containers are subject to availability. We may change specifications, withdraw a model, or substitute a component of equivalent or better quality without notice. If a substitution materially affects your order, we will contact you before proceeding.
05 Pricing and taxes
All prices are shown in Canadian dollars (CAD) and are exclusive of applicable taxes unless stated otherwise. Harmonised Sales Tax (HST) is applied at the rate in force in the delivery province at checkout. Our GST/HST registration number is [ADD YOUR GST/HST NUMBER].
Product prices cover the container only. Delivery, placement, and setup are quoted separately based on your location, site access, and configuration, and are confirmed in writing before installation.
We may change prices at any time. A price change does not affect an order we have already accepted. If a price is listed in error, we will contact you before processing and you may confirm at the corrected price or cancel for a full refund.
06 Orders and acceptance
Your order is an offer to buy or rent. An order confirmation email acknowledges that we received it — it is not acceptance. A contract forms only when we confirm the order in writing, or when we dispatch or deliver the container, whichever is earlier.
We may decline an order where the container is unavailable, the price or description was wrong, we cannot verify your payment or delivery details, delivery access is unsuitable, or we reasonably suspect fraud. If we decline after payment, we refund you in full.
07 Payment
We accept [LIST ACCEPTED PAYMENT METHODS — e.g. Visa, Mastercard, e-transfer]. Payment is processed by our payment provider; we do not store full card numbers.
Purchases are payable in full at checkout unless we agree different terms in writing. Rentals are billed monthly in advance. Late rental payments may attract interest at [ADD RATE, e.g. 2% per month / 26.82% per annum] and may result in suspension of access or removal of the container in accordance with your Rental Agreement.
Part B — Purchases
08 Delivery and site access
We deliver across New Brunswick, Nova Scotia, Prince Edward Island, and Newfoundland and Labrador, subject to access and availability. Delivery timing depends on your location, chosen model, and current stock, and we confirm an expected window once we review your delivery address.
Delivery dates are estimates and are not guaranteed. We are not liable for delays caused by weather, road conditions, carrier availability, or events outside our reasonable control.
You are responsible for ensuring that:
- The site is accessible to a delivery vehicle of the size required.
- An adult is present at the agreed time to direct placement and sign for delivery.
- Overhead obstructions, gates, driveways, and ground conditions permit safe access.
- You have the right to place a container at the site.
If delivery cannot be completed because the site is inaccessible, nobody is present, or placement is unsafe, a re-delivery charge may apply.
We are not liable for damage to driveways, lawns, paving, underground services, or landscaping caused by delivery vehicles or placement equipment where you have directed the route or placement position. Please tell us in advance about septic tanks, wells, drainage, and buried utilities.
09 Site preparation and permits
You are responsible for preparing the site. A reasonably level, stable, well-drained, and accessible surface is required so the container sits securely. We can advise on clearance and ground stability, but the final assessment is yours.
Permits and local requirements are your responsibility. Requirements vary by municipality and by placement. Before installation you should confirm local bylaws, zoning rules, setback requirements, permits, and any conditions imposed by a landlord, condominium corporation, or homeowners' association. We are not liable for fines, removal orders, or costs arising from placement that does not comply.
10 Assembly and setup
Alloy-Series containers use a bolt-together panel system and can be assembled with basic tools. Setup can be arranged with us, or handled by you or your own contractor.
Where you assemble the container yourself, you must follow the supplied instructions. We are not responsible for damage, injury, or loss of warranty coverage resulting from incorrect assembly, unsuitable ground, modification of components, or use of parts not supplied by us.
11 Title and risk
Risk in the goods passes to you on delivery to the site. Title passes only once we have received payment in full. Until then you must not sell, modify, or grant any security interest over the goods.
12 Cancellations and returns
You may cancel an order at no cost before it has been dispatched or scheduled for delivery. Once dispatched or scheduled, cancellation may attract a charge covering transport and handling already incurred.

Refunds are issued to the original payment method within [X] business days of us receiving and inspecting the returned goods.
13 Damaged or incorrect goods
Please inspect your container on delivery. Report any shortage, transit damage, or incorrect item to us within [X] days of delivery, with photographs. Where a claim is accepted, we will repair, replace, or refund the affected item at our option, and we will cover return transport where applicable.
14 Warranty
We warrant that Alloy-Series containers are free from defects in materials and workmanship for [X months/years] from the date of delivery, when assembled per instructions and used normally.
This warranty does not cover:
- Normal wear, surface marking, or gradual weathering of finishes.
- Damage from misuse, overloading, accident, vandalism, or storm and flood events.
- Damage from incorrect assembly, unsuitable or unstable ground, or relocation not carried out by us.
- Modification, drilling, or the addition of non-approved parts.
This warranty is in addition to, and does not replace, the statutory warranties you have as a consumer under the Consumer Product Warranty and Liability Act (New Brunswick) and comparable legislation in other Atlantic provinces.
Part C — Rentals
15 Rental terms
Rentals are month-to-month and billed monthly in advance. The rented container remains our property at all times. You receive a right to use it, not ownership, and you must not sell, sublet, or grant any interest in it.
Rental rates include delivery and pickup within our standard service area. Charges outside that area, or for additional relocations, are quoted separately.
16 Your responsibilities
During the rental you must:
- Use the container only for lawful storage, and not as a dwelling or workspace unless we have agreed in writing.
- Keep it secured and in the condition supplied, allowing for fair wear and tear.
- Not modify, paint, drill, weld, or attach anything to the container.
- Not move or relocate it without our written consent.
- Tell us promptly of any damage, loss, or theft.
- Give us reasonable access to inspect, maintain, or recover the container.
You are responsible for the cost of repairing damage beyond fair wear and tear, and for cleaning charges where a container is returned in an unreasonable condition.
17 Prohibited items
You must not store in any container:
- Flammable, explosive, corrosive, radioactive, or otherwise hazardous materials, including fuel, propane, and compressed gas.
- Illegal goods or substances, firearms, ammunition, or explosives.
- Perishable food, live animals, or anything likely to attract pests or produce odour.
- Cash, securities, jewellery, or items of exceptional or irreplaceable value.
- Anything whose storage would breach a law, bylaw, or insurance condition.
Breaching this section is grounds for immediate termination, and you are responsible for any resulting loss, damage, cleanup, or legal cost.
18 Insurance
We do not insure the contents of your container. Goods are stored at your own risk. You are responsible for arranging your own insurance covering theft, fire, water, weather, and accidental damage. Your home or business policy may extend to stored goods — check with your insurer.
19 Ending a rental
You may end a month-to-month rental by giving us [X days, e.g. 14 days] written notice. There is no penalty for ending early. Rental charges continue until the container has been emptied and made available for pickup.
We may end a rental on written notice if payment is overdue by more than [X] days, if prohibited items are stored, or if these terms or your Rental Agreement are otherwise materially breached. Where a rental ends and goods remain in the container, we will deal with them in accordance with applicable New Brunswick law after giving you reasonable notice.
Part D — Legal
20 Limitation of liability
To the fullest extent permitted by law, and subject to the banner at the top of this page, our total liability arising from any order is limited to the amount you paid for the container or rental period giving rise to the claim.
We are not liable for indirect or consequential loss, including lost profit, lost business, loss of use, or loss of data. We are not liable for loss of or damage to goods stored in a container, which are stored at your risk.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
21 Indemnity
You agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these terms, your use or placement of a container, your storage of prohibited items, or your failure to obtain a required permit or approval.
22 Events beyond our control
We are not liable for failure or delay caused by events beyond our reasonable control, including severe weather, storms, flooding, fire, labour disputes, supply shortages, transport failure, road closures, utility failure, epidemic, or government action. If such an event continues for more than [X] days, either party may cancel the affected order and we will refund sums paid for goods not supplied.
23 Intellectual property
All content on this website — including the Alloy Storage name, logo, product names, text, photographs, renders, and layout — is owned by us or our licensors and protected by Canadian and international law. You may view and print pages for your own use. Any other reproduction, distribution, or commercial use requires our prior written permission.
24 Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms and explains what we collect, why, and how you can access or correct it.
25 Changes to these terms
We may revise these terms at any time. The version in force when you place an order is the version that applies to that order. The date at the top of this page shows when it was last revised.
26 Governing law
These terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada that apply there. Disputes are subject to the non-exclusive jurisdiction of the courts of New Brunswick.
If you are a consumer, this does not deprive you of the protection of the consumer protection laws of the province where you live.
27 General
- Severability — if any provision is found unenforceable, the rest remain in force.
- Waiver — a delay in enforcing a right is not a waiver of it.
- Entire agreement — these terms, your order confirmation, and any Rental Agreement form the whole agreement between us.
- Assignment — you may not transfer your rights without our written consent. We may assign ours on notice.
- Language — the parties have requested that these terms be drawn up in English. Les parties ont demandé que ces conditions soient rédigées en anglais.
